Venue in FELA – Railroad Injury Cases
In a legal context, “venue” refers to the geographic location where a trial or legal proceeding is to be held. In civil cases, venue can be determined by factors like where the incident occurred, where the defendant resides, or where the contract was entered into.
In FELA cases, venue is generally determined by one of three factors: the location of the accident, the railroad’s principal place of business, or the railroad’s state of incorporation. Specifically, FELA suits can be brought in the county where the accident occurred, in the county where the railroad has its principal office, or in the county where the plaintiff resided at the time the cause of action accrued.
