Here are 5 Key Tips for railroaders to protect themselves financially if you are injured by a negligent truck driver.
1. Get Uninsured/Under Insured Motorist Coverage
Your own auto insurance policy may protect you even when you are injured on the train. This is especially necessary if the truck insurance is not enough to cover both your financial damages and the property damage to the train.
2. Keep in Mind that the Whole Event is Being Filmed
The locomotive has a camera which faces several directions. The police have a dash cam and body cam with AUDIO. And, the truck may also have a camera. Anything you say and do may be recorded and could become a factor later in your case.
3. Report Any Injury to the Police and the Railroad
- The police writedown what you say, so inform them of any injuries even if they seem minor.
- If you are clearly hurt: Go to an emergency room. Report the injury to the railroad and fill out the necessary injury report. Then follow up with a good doctor.
- Please Note: It’s not always immediately obvious what your injuries are. Many railroaders don’t realize their injuries are significant until the morning after the wreck. This is extremely common and shouldn’t keep you from reporting the injury as soon as you realize you do need medical attention.
4. Preserve Vital Information
Get the name of the trucking company and also their DOT number if at all possible. Also, save your consist, air brake slip, and take a picture of any damage to the locomotive.
